Terms of Use
Please read these Terms of Use (the "Terms"/the “Terms of Use”) carefully as they constitute an agreement between you (“You”/ the “User”), and Netherlands Institute for Multiparty Democracy (“NIMD”/"We”/"Us”/"Our”/”Ourselves”), the provider of the MyDemocracy School, including the education assistance and its related training materials which are made accessible in the Application and the Website.
By registering or using Our Application and/or the Website and/or services of in any manner, You are indicating that You understand and consent to be bound by all the Terms of Use outlined below.
1. Definitions
“Account(s)” means account provided by NIMD upon registration for the purpose of conducting/obtaining Services on the platform.
“Application” means MyDemocracy School developed by NIMD.
“Content” means content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available to You or by You, regardless of the form of that content.
“Content Provider(s)” means any person or organization creating the Content available on the platform which includes any publicly accessible materials, publications and/or programs.
“Website” means the website of the Application of which is https://mydemocracyschool.com or as it may change from time to time.
“Privacy Policy” refers to the privacy policy of the Application attached together with this Terms of Use.
“Service” refers to the whole range of publications and academic support programs provided by NIMD, including but not limited to a variety of training programs, courses, functions and initiatives that are made available on the Website/Application.
2. Acceptance of Terms
2.1 By accessing and using Our Website/Application, User hereby reads, understands, accepts and agrees to be bound by these Terms of Use and Privacy Policy. Should User not accept these Terms and Privacy Policy, User shall neither access nor otherwise use any part of the Website/Application or Content or information available therewith.
3. Account Registration and Management
3.1 To use certain features of the Application, You may be asked to create an Account to register and access Our Application. When setting up your Account, You will be required to provide your (1) name, (2) date of birth, (3) the state you are residing in, and (4) trainings you attended with Us. In doing so, You must provide and continue to provide accurate, correct, and updated information. Once the Account registration has completed, user ID will be generated for each user.
3.2 You have complete responsibility for your Account including any harm or damage caused by someone using your Account without your permission. Thus, You may not transfer your Account to someone else or use someone else’s Account.
3.3 You must notify us immediately upon learning that someone else may be using your Account without your permission (or if You suspect any other breach of security).
4. Service Fees and Charges
4.1 MyDemocracy School is free to use and access, except for any internet or mobile service bills of your own. You will not be charged for any registration or subscription by Us.
5. Behavior Rules
5.1 You must not use the Website/Application for any wrongful reasons, or with malicious intent.
5.2 We encourage commentary about people and matters of public interest, but abusive or otherwise inappropriate Content directed at private individuals is not allowed. We have the right to remove any inappropriate Content You made using Our Service.
5.3 In the cases of inappropriate, fraudulent, or unlawful behaviors, We may restrict or terminate your permission to use Our platform and Services, with or without notice.
5.4 If You believe your permission to access the platform has been mistakenly revoked, You may contact Us and request to regain access to the Application.
5.5 NIMD shall not be responsible for any conduct of any User in Website/Application.
6. Scope
6.1 Our Website/Application is most relevant to people residing in Myanmar. We do not represent that Content available on or through Our Website/Application is appropriate for use or available in other locations.
7. No Academic Credit
7.1 We do not grant academic credit for the completion of any program or course unless otherwise explicitly indicated. Even in cases where credit is awarded, there is no presumption that other institutions will accept that credit.
7.2 MyDemocracy School and the associated Content Providers have no obligation to have their respective programs or course recognized by any educational institution or accreditation organization.
8. Content Ownership
8.1 By using Our Application, You will be made accessible to a number of publications, features and materials. All the materials available on the platform has acquired the consent of original Content Provider. While NIMD or MyDemocracy School has the right to share and upload the Contents on the platform, the Content Providers will be duly credited and will not lose the ownership rights over their Content.
8.2 We do not review or edit Content of any publications or materials available on the platform unless they are materials issued under the name of NIMD. Thus, We disclaim that We do not exercise any editorial control over them, as such, We cannot guarantee the reliability, validity, accuracy, or truthfulness of the Content.
9. Security
9.1 We care about the security of Our Users. While We work to protect the security of your Account and related information, MyDemocracy School cannot guarantee that unauthorized third parties will not be able to defeat Our security measures. For your further assistance, kindly examine Our Privacy Policy.
10. Governing Law
10.1 The Services are managed by NIMD, which is in the Hague, the Netherlands. You agree that these Terms will be governed by the laws of the Kingdom of the Netherlands.
10.2 This section shall not deprive You of any mandatory consumer protections under the law of the country to which We direct Services to You, where You have your habitual residence.
11. Dispute Resolution
11.1 Any dispute will be resolved amicably through negotiation within fourteen (14) days from the date the Notice of Dispute is sent, or otherwise such dispute shall be referred to any respective courts having jurisdiction under the laws of the Netherlands.
12. General Provisions
12.1 These Terms of Use, together with the Privacy Policy, EULA and any other legal notices published by NIMD on the Services, shall constitute the entire agreement between You and NIMD.
12.2 If any clause of these Terms of Use is or become illegal, invalid, or unenforceable, in whole or in part, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable and the validity and enforceability of the rest of the provisions shall not be affected. If You do not comply with these Terms, and We do not take immediate action, this does not indicate that We relinquish any rights that We may have (such as taking action in the future).
12.3 Neither NIMD or the User is not liable for any failure in their part due to causes beyond its reasonable control including, but not limited to, acts of God, war, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances.
12.4 If the interpretation of words and meanings of these Terms of Use and Privacy Policy is different between English language and Burmese language, the English version will prevail.
13. Changes to the Terms
13.1 We reserve the right to revise, change, modified or update the Terms at Our sole discretion at any time. Any revision to the Terms will be effective immediately upon posting by Us. For any material changes to the Terms, We will take reasonable steps to notify You of such changes, via a banner on the website, email notification, another method, or combination of methods. In all cases, your continued use of the Services after publication of such changes, with or without notification, constitutes binding acceptance of such revised Terms.
14. Termination
14.1 You may terminate this Terms at any any time by closing your Account, discontinuing any access to or use of Our Website/Application.
14.2 We shall have the right to close or suspend the access to your Account in Website/Application or terminate any permission granted to You hereunder in case of breaching these Terms for any reason or any activities that We deemed suspected and without notice or liability of any kind.
15. Disclaimer
15.1 The information and materials on the Website/Application provided to You are for the information and education purposes only and on an “as is” and “as available” basis without representation, warranties or guarantees of any kind either express or implied.
15.2 The information, references and materials on the Website/Application do not represent and reflect the position of NIMD and/or Demo Finland.
15.3 We respect the intellectual property rights of others. We give authorship or ownership credit to relevant author of materials that We may used or referred as the case may be by stating so in Our Website/Application or in any online publication under the control of NIMD.
16. Intellectual Property
16.1 The Service and its original Content (excluding the source of references from other organization), features, and functionality are and will remain the exclusive property of the NIMD and its licensors.
16.2 The Service is protected by copyright, trademark and other laws of both the Netherlands and foreign countries.
16.3 Our trademark may not be used in connection with any product or service without the prior written consent of the NIMD.
